Family Educational Rights & Privacy Act

FERPA

FERPA is a Federal law that was passed in 1974 that protects the privacy of student education records. These rights transfer to the student when he or she reaches the age of 18 or attends a school beyond the high school level.

FERPA includes the following:

 

  • Parents as well as eligible students (students 18 years of age) have the right to view the student's education records.

 

  • Parents as well as eligible students are able to request that the school correct records if they contain inaccurate information.

 

  • Schools must have written permission from the parent or eligible student in order to release any information from a student's record. 

FAPE is an educational right of all students with disabilities in the United States to 'Free & Appropriate Education.' It is part of the Individuals with Disabilities Education Act (IDEA) and guaranteed by the Rehabilitation Act of 1973. It is individualized towards all student to meet their needs. When a school provides FAPE to students with disabilities, they (the school) allocates specialized instruction and related services, that prepares the students for further education, employment, and independent living.
